MTA's accident/incident reports are generated at the request of counsel in anticipation of litigation and are therefore privileged attorney work-product documents. Additionally, accident reports submitted to the California Public Utilities Commission are confidential pursuant to Public Utilities Code Section 315, Public Utilities Commission General Order 164 and FTA guidelines. Therefore these reports are exempt from disclosure pursuant to Government Code Sections 6254 (k) privilege, 6254 (f) investigations and 6255 (a) ...on the facts of the particular case the public interest served by not disclosing the record clearly outweighs the public interest served by disclosure of the record.

You may contact me at williamsch@metro.net if you have any questions related to this public records request.
