Request #20-30

This request is a followup on 18-1158 so please refer to that for background.  That request asked for the following, apparently not produced. I am asking for it to be produced now or explicit exemptions to be stated after an actual adequate search has been made.


* communications to or from any Metro or County employee concerning the use of millimeter wave scanners or any other full-body scanning devices;


* communications to or from any Metro or Country employee to any third-party vendor that sells, leases, or otherwise makes available millimeter wave scanners or any other full-body scanning devices, including but not limited to Thruvision;


* communications, memoranda, or documents shared by, created by, or delivered to the United States Transportation Security Administration concerning the trial, acquisition, installation, or use of millimeter wave scanners or any other full-body scanning devices;


* Any document that describes, discusses, or mentions the specifications and effectiveness of millimeter wave scanners or any other full-body scanning devices, including their efficacy, error rates (both false positives and false negatives), resolution, imaging capacity, and data retention capacity.

The contract has been redacted and the communications have been deemed safety and security sensitive and will not be released. Government Code 6255(a) permits a public agency to withhold documents when “on the facts of the particular case the public interest served by not making the records public clearly outweighs the public interest served by disclosure of the records” and Metro Policy Gen8 1.4.1. 

Metro's NextRequest (Public Records Tracking System) is maintained in compliance with Metro's records retention policy and records schedule. Requests and attachments will be removed from this system according to Metro’s records retention schedule.  This is to maintain the consistency and integrity of the records management program, as well as the utility of this system.

 If applicable, please note: The records requests themselves and any attachments will be deleted 3 Years after request closure.

If records are made available, please make sure you access/download/pick-up the records as soon as possible.  System records will be removed automatically at their expiration periods. Use of this system is not intended to extend or reduce Metro's adopted retention schedule time periods.
